补偿贸易知识问答
补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]是指国外厂商提供或利用国外进[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]信贷进口生产技术和设备，有我方企业进行生产，以返销其产品的方式分期偿还对方技术、设备价款或信贷本息的[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]方式。
二、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有那些形式?
1.产品返销一称回购[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]或简称返销
在补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]中,用进口的设备或其他物资生产的产品,通称为直接产品,用直接产品支付的,叫产品返销。一般适用于设备和技术[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url],在国际上有人称之为"[url=http://www.cnexp.net/fenlei_xinxi/gongye/Index.html][color=#0000ff]工业[/color][/url]补偿"。在我国,一般称之为直接补偿。
2.商品换购,统称互购
首次进口的一方用于支付进口货款的商品,不是由进口物质直接生产出来的产品,而是双方商定的其他商品,即间接产品。由于这种[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有时候并不直接与其他生产相联系,故在发达资本主义国家有人称之为"商业性"补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]。由于这种补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]用间接产品偿还,在我国一般称之为间接补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]。
3.多边补偿或叫转手补偿
这种形式的补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]形式比较复杂。由第三国替代首次进口的一方承担或提供补偿产品的义务。
三、[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]与一般[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有什么区别?
补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]与一般[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有以下区别:
1.一般[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]通常是以货币为支付手段。补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]实质上是用商品为支付的。
2.一般商品通常不用以信贷为条件,补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]往往是离不开信贷,信贷往往是这种[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]的组成部份。
3.一般[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url],一方为买方,另一方为卖方,交易手续简便。补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]双方,既是买方,又是卖方,具有两重身份,有时供货或销售的义务还可让给第三方,交易手续比较复杂。
四、偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]与易货[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有什么区别?
补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]与易货[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有以下区别:
两者都是买卖双方直接进行交换,一般不发生货币的流通,货币在这些[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]中仅仅是计价的手段。两者的不同之处是:易货[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]往往是一次性行为,买卖过程同时发生,大致同时结束。补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]往往持续时间过长,有的3至5年,有的长达10年以上,每一笔交易往往[url=http://www.cnexp.net/fenlei_xinxi/bao/Index.html][color=#0000ff]包[/color][/url]括多次的买卖活动。
五、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]怎样向海关办理登记备案手续?
执行补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]的经营单位和生产企业,应于[url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]批准之日起1个月内向海关申请备案登记,同时提交下列单证:
1.经贸主管部门签发的批准书和[url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]备案证明书。
2.工商行政管理部门颁发的营业执照。
3.对外签订的[url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]副本。
4.对外经贸主管部门批准立项的应领[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]货物许可证的[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]成品批件。
5.海关认为必要的其他单证和经济担保。
海关在对上述单证审核后,对符合补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]条件予以备案,并核发《[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]装配和中小型补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]进口货物登记手册》,凭以办理货物的[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_baoguan/index.html][color=#0000ff]报关[/color][/url]手续。
六、 补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]项下进[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]货物怎样办理[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_baoguan/index.html][color=#0000ff]报关[/color][/url]手续?
补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]的原材料、零部件、元器件和设备进口，以及[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]成品[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]时，有关[url=http://www.cnexp.net/index.html][color=#0000ff]外贸[/color][/url]（工贸）公司和生产公司单位应持凭《登记手册》和填写的货物[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_baoguan/index.html][color=#0000ff]报关[/color][/url]单1式3份，向进[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]地海关申报，并交验货物的运单、发票、装箱单等有关单证。
七、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]项下进口的设备，自进口之日起至全部偿还上，属海关监管货物。未经对外经贸 管理部门许可和海关批准，任何单位和个人均不得擅自出售、转让、变卖或提取移作他用。如因故需变卖处理的，要报经贸主管部门许可，报海关批准，并按章补纳关税；如属许可证管理商品，还应交验进口许可证。
八、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]产品能否转让第三方?
可以，中外双方在补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]中规定将产品转售给双方指定的第三方，且第三方须同时在[url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]上签字确认，但不能由中方自行销售给第三方或代外商外商销售。如补偿产品属国家[url=http://www.cnexp.net/fenlei_xinxi/naobaijin/Index.html][color=#0000ff]统一[/color][/url]经营、有[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]配额和[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]许可证管理商品的[url=http://www.cnexp.net/fenlei_xinxi/xiangmu/Index.html][color=#0000ff]项目[/color][/url]，事先应报经贸部审批。
九、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]执行完毕是否可继续[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]产品?
可以。但对继续[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]的产品以及[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]收购进的设备和其他物资，应按一般进[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]货物办理手续，不能作为补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]。
十、[url=http://www.cnexp.net/waimao_zhishi/waimao_guoji_zulin/index.html][color=#0000ff]租赁[/color][/url]进口设备能否搞补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]?
[url=http://www.cnexp.net/waimao_zhishi/waimao_guoji_zulin/index.html][color=#0000ff]租赁[/color][/url]进口设备搞补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]有以下两种情况：
1.[url=http://www.cnexp.net/waimao_zhishi/waimao_guoji_zulin/index.html][color=#0000ff]租赁[/color][/url]公司自行[url=http://www.cnexp.net/waimao_zhishi/waimao_guoji_zulin/index.html][color=#0000ff]租赁[/color][/url]、租借设备进口后，转租或转借给从事补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]企业的，应照章纳税。
2.[url=http://www.cnexp.net/waimao_zhishi/waimao_guoji_zulin/index.html][color=#0000ff]租赁[/color][/url]公司受外商委托[url=http://www.cnexp.net/waimao_zhishi/waimao_guoji_zulin/index.html][color=#0000ff]租赁[/color][/url]设备进口从事来料[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]的，符合补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]条件的，海关将给予相应的优惠。
十一、进料[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]项下的成品不能作为补偿产品[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]。如用进料[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]项下的[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]成品作为补偿外商所提供的技术设备价款或信贷本息，实际上等于以现汇购买了有关进口技术设备，不符合补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]的有关规定。
十二、补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]到期或执行完毕后，怎样向海关办理[url=http://www.cnexp.net/waimao_zhishi/waimao_waihui_hexiao/index.html][color=#0000ff]核销[/color][/url]手续?
补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]到期或最后一批成品[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]之日起1个月内，有关单位应如实填写好《登记手册》内的[url=http://www.cnexp.net/waimao_zhishi/waimao_waihui_hexiao/index.html][color=#0000ff]核销[/color][/url]申请表（单位盖章）连同货物进口时经口岸海关盖章的进[url=http://www.cnexp.net/index.html][color=#0000ff]出口[/color][/url]货物专用[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_baoguan/index.html][color=#0000ff]报关[/color][/url]单送交主管海关办理[url=http://www.cnexp.net/waimao_zhishi/waimao_waihui_hexiao/index.html][color=#0000ff]核销[/color][/url]结案手续。
十三、若国内原料缺乏，是否可以从国外进口原料生产成品偿还补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url]设备价款?
在签订补偿[url=http://www.cnexp.net/fenlei_xinxi/maoyi/Index.html][color=#0000ff]贸易[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]之前，应该进行可行性研究。原材料问题是可行性研究的一个重要课题。如果原材料问题不能解决，就应该停止对外谈判，或者改签[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]装配[url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]，进口的设备以工缴费偿还。如果已经签订了[url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]，国内原材料突发性短缺，为了[url=http://www.cnexp.net/chukou_liucheng/chukou_hetong_lvxing/index.html][color=#0000ff]履行[/color][/url][url=http://www.cnexp.net/waimao_zhishi/waimao_export_hetong/index.html][color=#0000ff]合同[/color][/url]，必须从国外进口原材料，则该进口的原材料虽然将生产成品返销国外，属于进料[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]性质，但不能给予减免进口税的优惠。如果原材料进口税负过高，有关企业承受不了，在经有关机关批准原材料进口可作进料[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]办理的情况下，海关可按进料[url=http://www.cnexp.net/waimao_zhishi/waimao_chukou_jiagong/index.html][color=#0000ff]加工[/color][/url]规定给予减免税，但凡以减免税进口的原材料生产成本偿还价款的部分设备，海关将补征设备的进口税。
